Dear Alice Black,
Thank you for your letter dated 19th August 2009.
Having looked at my up-to-date credit report I have seen the correction to card ending 2053 has been amended to show no outstanding balance.
You have updated the account to say that it was settled in January 2009. Unfortunately this was settled on the 23rd of October 2007 and the account was closed immediately after payment was made.
Please can you amend with the correct info of when the account was settled and closed as it was not settled in Jan 2009.
On a different matter in regards to the history on the account.
This is the current information that has been updated to my credit file.

March Statement – 23rd February £15.00 paid.
April Statement – Late charges.
May Statement – Late charges
June Statement – Date Request letter sent and customer services advised that disputing unfair charges.
With my calculations please see below the correct information that should be on my file.

History of account
On the 5th June I wrote a letter asking for my copies of all my statements and advised your customer services that I was going to dispute the unfair charges applied to my account.
Section 13.6 of the banking code states
13.6 We may give information to the credit reference agencies about the personal debt you owe us if
You were advised on the 5th June that I was disputing the charges, thus according to section 13.6 of the banking code you cannot update my credit file.
You kindly sent me copies of my statements from which I then sent you a letter dated 8th July asking for the unfair charges paid back to me. This was followed up with another letter dated 26th July asking again for my charges to be refunded back to me.
On the 21st August I filed court proceedings to recover these charges.
This was finally settled out of court in full and the balance on £421.00 was paid on 23rd October and the account closed.
I calculate that this matter has taken me in excess on 15 hours on my time, plus the numerous calls to your customer services, not to mention the inaccurate data and the adverse effect on my credit rating.
You sent me a cheque for £25.00 to cover my costs, which I have not cashed.
The rate I am allowed to charge in these matters is £10.00 per hour plus costs. Therefore your cheque of £25.00 is well below this.
True cost.
This includes time take to write letters, make phone calls and the cost of stationary is £190.00. This does not take into account the adverse effect it has on my credit file and the repercussions for me to obtain a decent % rate of credit have been diminished.
For this inconvenience I have will accept a settlement figure of £2000 plus cost of £190.00.
Total figure £2190.00.
I am sure that the figure is much more as I have a mortgage and 2 credit cards all at a high rate.
Please note that this letter has been sent to the Financial Ombudsman Services and the Information Commissioner.
I look forward to your reply within 14 days before I proceed to court.

- You have not made proposals we are satisfied with for repaying your debt, following our formal demand.

The letter is fine, but not sure why your giving them 14 days before going to court, but also mentioning Ombudsman and ICO......
If your intending to use the Ombudsman the bank has 8 weeks0 -
The fact that you consider the account to have been in dispute in 2007 doesn't change the fact that once the dispute was resolved the true payment history would be reinstated. The dispute doesnt appear to be that the debt was actually owed, or that a contractual payment was required to be made by you.
Only threaten court action if you mean it. If I was them I wouldn't think that you meant it.
What would you put on your particulars of claim? If it seems to me that you are pushing your luck with your claim for £2190 then it could well seem the same to a judge.0 -
Would agree with Brock that a claim for £2190 does seem unrealistic, especially as you appear to have plucked figure of £2,000 out of the air.
It might be advisable to head letter COMPENSATION CLAIM, as only at end of letter do you mention this, by which time letter reader may well have "switched off".If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0 -
