Thank you for all the replies. Of course I know that the ethically correct/right thing etc would be to give them a call but what if I don't. Could I get into trouble legally? If they want it back then surely the onus should be on them to ask for it? I could do a nice thing and call them/the bank up but truth be told cash is tight and I'm hoping they wont ask for it back so that we can sell it. Flame me for it as i'm sure some of you will but thats the crux, there is no point me beating around the bush. I just want to know if legally I'm doing anything wrong in not contacting them and just waiting for them to contact me - if they ever do. I'm sure I heard of a piece of regulation that states if someone sends something unsolicited to your house then after a certain timescale it is yours?

Speak to your bank, if they compensated you then it is their property.

I agree with Money maker. Call your bank and ask them what to do. If it is their property and they would like it back, ask them to compensate you for the postal cost. If they say that they haven't paid the retailer for it, then contact the retailer and tell them that if they want it back, they should compensate you for the postal cost.

Nothing may happen, something may happen?
The bank or retailer wants the money or the goods that they have lost as a result of the fraud. Is it worth the chance just because you are short of money!

You will have to go by your conscience and accept the consequences of that decision!

  • Just another thought - could it have been a competition prize? They do sometimes come out of the blue with no note etc, it is not normal for retailers to send something out without invoice/note or some such.

  • Don't sell it. It may have been sent to your address, but banks tend to investigate fraudulent criminal activity - and this watch is most likely going to be part of that investigation.
Phone and ask the bank - it's the safe way.
Try saying "I have under-a-pound in my wallet" and listen to people react!
  • if you haven't paid for goods they don't belong to you. If you use them or sell them...that's a criminal offence. If you know who sent them, tell them in writing to collect within 6 weeks or you will dispose of them. If you don't know who sent them, forward them to the police, because as stated they aren't yours.

I see your point, but I don't think you should take the chance.
