Advance payment

I read somewhere that once an NRP is paying their arrears regularly, you can apply for advance payment of the rest.....did i just dream this or has anyone any experience of doing this?

Hi, as far as I am aware, and by what I was told by the CSA, you need to show maladministration by the CSA to claim for arrears in advance. If the arrears were due to the CSA taking 12 weeks to process a change of circumstances (this appears to be the alloted time allowed for such things) then you wont get a special payment for arrears as there is no maladministration. However I had a CS1 case for my daughter, that ICE found maladministration etc on, and I ended up getting nearly all of my arrears back as a special payment. I currently have a claim in with the CSA for a special payment for my CS2 case where it took them over 8 months to do a calculation and get me my first payment as their systems wouldn't accept the CS2 case because of my CS1 case. My claim is that CSA cause unnecessary delay as it took them well over the allocated 12 weeks to even decide that the case was to be made clerical. I am still waiting for an answer. I will add that I would never have known about special payments or advance payments of maintenance if it had not been for the person at ICE dealing with my CS1 complaint. You also need to show an active interest in your case too according to the guidance being able to claim a special payment.

My case is a CS1 case and it took me almost 9 years to secure any kind of payment out of my ex. I put a complaint in , in Feb 2008 which looked like it was filed in the bin. I had a consolotory payment from CSA in May this year. Ex has been paying his arrears now since Feb.(After takng my case to my MP).
So not sure whether this entitles me to apply for an advance or not?0 -
