MBNA credit limit increase negligence???

I'm currently going through a Debt Management Plan with the CCCS. My other creditors are fine, except MBNA. Solicitors letters, screaming down the phone, adding pure interest to my debt. The list goes on.

Today's screaming match from the guy (who I couldn't understand due to his dialect) ended all of a sudden when I mentioned MBNA were being negligent in dishing out credit limit increases without me asking for them, or even signing them off?! I can't believe how this guys tone changed.

Is the right? Have MBNA been negligent in dishing out these stupid credit limit increases, and would I have a case at wiping them off, and who do I contact???

    Negligent how? They didn't put a gun to your head to force you to spend your credit limit....

    Surely if you are in a DMP with CCCS they should be dealing directly with CCCS? Did they call you or did you call them?

  • I just think it's negligence on their behalf dishing out thousands extra on a credit limit to a customer who in all fairness would never be able to pay the sum back. You want to believe in yourself that you can pay it back, but in reality you know it's totally out of your grasp and this is why I'm now in this mess like thousands of others. If it's handed on a plate, you take it.

    The CCCS are being good, it's just MBNA are starting to be clever with their phonecalls including dialing different numbers from a Chester area code.

    But this assumes they have an indepth knowledge of your finances, know exactly what you spend on food etc and therefore can tell what your disposable income is. They can only make an estimate of it and that is what they base their credit limits on.

    I would tell CCCS that MBNA are calling you directly and ask them to send them a letter telling them not to. If you have the details of the caller (Name, number, time, date) then provide that to CCCS as well.
