Car on Hire Purchase

My girlfriend has a car on hire-purchase, at the end of last year she missed 2-3payments due to being made redundant twice ( :( ) .. So now we are paying the money every month, although we are in arrears by the 3 payments, we are also getting charged £25.00 for each letter they send out telling her she is in arrears. After numerous telephone calls to settle the debt, my girlfriend has offered to increase the monthly payment over a few months, but they have demanded she has to pay it back over 2 months aswell as pay the regular for the car. The arrears as it stands is £700 pounds or so, so split over 2 months with the regular would be £500 round about, which as it stands is quite impossible as my girlfriend is still unemployed, (just gave birth), and i am supporting her regular payments. But recently we received a telephone call again from the hire purchase company asking for her to pay the arrears, saying she has to pay the arrears over 2months but admitted when it 1st happened she should of been given the option to pay other 6months, which would of been possible because the arrears wouldn't of been £700 they would of only been £350-400. Does anyone know where she would stand with this and if possible anything she can do to clear this up, its not as if she doesn't want to pay, its the amount they want her to pay off and how quickly.

    Who is the hire agreement with? What's the finance terms (value, APR, monthly payment).

    They can't charge you £25 per letter, that's fudging ridiculous, I had to threaten GE Money with court action on my hire purchase agreement, arrears of £75 accrued because when I made the payment to bring the arrears up to date they took it off of the loan balance and not the arrears.... idiots.

    I can give you a hand in starting the process if you need it?

    **Edit, just realised I may not be clear, the admin fees and late charges on your account would probably be reversed if bought to the attention of the court as they aren't representative of the fees incurred by the HP company, therefore you could get these written off/reduced significantly.

    You would have to prepare a LBA (letter before action) in the first instance. Oh and you can probably put the account into dispute so they can't add further charges until the matter is resolved.
  • Aaaaah getting somewhere, my girlfriend is just getting her haircut, as soon as she is finished I will get the car details off her, and relay them here for you, the value, apr and monthly payment.

    I know its through British Credit Trust, her monthly payment is £166. She gets 2 letters in the same envelope.

    1st letter saying basically she has not been charged for this letter and saying there is a default sums attached and on that letter says she is getting charged £25 for that letter.
