Court Claim Form

Just recieved one today from solicitors acting for Phoenix Recoveries - who failed to provide a CCA until recently many months after requesting it and after letters were sent to let them know that they had failed to supply within prescribed time limits.

Now I have heard many people say that the law changed regarding this - I want to know when that was and whether it affects those requests prior to the change.

Can someone also take a look at the one that was sent and let me know if it is complete.

I have had to put in a defence claim and get 28 days to sort things out because I have been out of hospital for just over a week and can't go scrabbling around in boxes trying to find all the info I need - if it is in fact needed.

Oh final point they are claiming for goods recieved between the date of this agreement and 2008 (when I know reduced payments were being made from 2006 and have proof of this - somewhere in a safe place :rolleyes:)

    Is your signature on the agreement dated 6/9/03?
  • yeah I took it off for scanning purposes along with any other info relating to me - although they are claiming for goods prior to this date

    Please don't think I am desperately looking for a unscrupulous way of getting out of paying this - I know I owe it - I just want to make sure they are playing along with the correct rules because after a couple of years of trying to be reasonable and getting this sorted I am just at my wits end with them.
