What do I do next please!!!

I received a letter from Additions after I sent 12+2, here http://www.picturetrail.com/sfx/album/view/22502889

What is the next step?

Also on that same link is the letter I received from HSBC, saying they want a higher F&F. Should I do this? How much to?

My plan for all four major debts is F&F settlement, but I have very limited resources. I offered HSBC £500 on a debt of nearly £1200.

Barclaycard (who have my LV debt as I think they took the card over) haven't replied to a single letter. Not to the CCA letter, or the 12+2, what do I do next???? Thanks!

I am struggleing to read the Additions letter and cannot print it but it appears to be a version of the moral responsibility letter some try. This only counts if the account was opened before April 2007:

    1. Yes the debt "exists"
    2. But the debt is unenforceable in court.
    3. If they have already registered a default, then there is nothing further they can do to affect your credit rating.

It is for you to decide whether to continue paying and how much.

If they try to enforce the debt
    1. Defend on the grounds there is no CCA.
    2. Report them to the OFT who have already boolocked some DCas for chasing debts which are in dispute because no CCA has been provided.

    Id the barclays debt defaulted?
If you've have not made a mistake, you've made nothing
  • What do you mean by defaulted?

I was planning on offering Additions a F&F settlement, the debts around £700, what would they take seriously? And is there a template to the effect of, 'bearing in mind this is unenforceable..... I'm offering x'

What about HSBC, this is more just, what will they consider, and should I do it over the phone?

If the debt is unenforceable then ignore it! You do not have a LEGAL obligation to pay them; they are saying that you have a MORAL obligation to pay and whilst having morals is good I'd deal with the debts you are legally obliged to pay before you decide what (if anything) to do with any debts you are morally obliged to pay!

  • Ok. What do I do about Barclaycard who haven't ever acknowledged a single letter?
  • Additions have today sent me a default notice! What does that mean to the debt?

I phoned HSBC who told me that £500 was too low, but they'd consider £735.93 (?) I said I could -possibly- raise £700, so they are 'authorising' it and will respond by post.
