Broken arm & Sick pay advice

My mate broke works in as agency staff in a day care home as well as doing the occasional shift in a care home on an agency basis & has worked in this arrangement for about 6 months but has never been offered a proper contract.

However they've broken their arm yesterday, they want to work still but have been told by the day care centre that they can't work for health and safety reasons. As they're agency there is no sick pay scheme for them.

What help is out there for them? They really can't face not earning for the next 2 months while their arm recovers, and it seems pretty unfair that they're unwilling to let them work when they're willing to.

Someone said something about statutory sick pay, can they claim this right away or do they have to wait a week (and miss out on a week's pay?). And also if they were on this statutory sick pay from the day centre would they still be able to do the occasional shift at the care home (that seem willing to still allow them to work).

My mate is really worried about money as you can imagine, I guess it shows one of the hazards of working long-term for an agency.

  • There is a period of 3 qualifying days - qualifying days being days normally worked - before sick pay is paid. SSP is currently £79.15 per week and should be paid by the employer, in this case the agency.

    If he has two jobs and one allows him to work, then this will affect any payments to him.

    So say my mate gets £250 a week from their usual job and usually does 1 shift a week at the care home for £40 now they will only get £79.15 for the first job less whatever they earn from the second job so £79.15 basically? Feel absolutely gutted for them, especcially as they're willing and able to perform the vast majority of their duties, have just been told to stay away for "health and safety reasons".

  • It is difficult because he is agency. However, get him to try a different tack. Either ask the agency for different work while his arm is incapacitated - or ask for an explanation as to why a broken arm prevents him from working in his first job. He could ask to meet with his manager and go through his job and what he can/cant do and what he could do to fill the gaps.
