Hello
This is likely to be just a scare tactic from Nat West to make you pay more.
As an example, before my DMP kicked in, Nationwide told me over the phone (when chasing for payment) that they would get a charging order but have not yet done so, though they have been my most difficult creditor to deal with.
If you are worried about Nat West (or any other creditors) getting a charging order, do read the factsheet on the National Debtline's web site:
http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=15_charging_orders_in_the_county_court
Don't let Nat West's likely scare tactics put you off doing the DMP with the CCCS. For me, it's the best thing I could have ever done. Yes, the first couple of months are a bit grim while it settles down but after that, I've hardly heard a peep out of my creditors. Though I've had a bit of grief from Nationwide, all others have accepted my DMP for a year at a time, when it's reviewed - I've now been on my DMP for 18 months and all is going really well.
Starting a DMP should also work in your favour if any creditors do go for a CCJ and then a charging order. At court, you will be able to show that you're working at repaying your debts and can show that you can't afford any more, etc.
Hope that helps - and good luck!Debt Jan 2008: £45,566. *** June 2013: DEBT FREE! ***
Paid back just under £50,000 due to some interest added.
Dealt with my debt through a Step Change (CCCS) DMP.
