Statute Barred?

Cabot Financial are trying to get me to settle a statute barred debt.

Since I sent them a "statute barred" letter they have tried to contact me on my mobile at least once a day.

Today they have started a new strategy, they rang my mobile every hour from 8:00am until I switched my phone off at 8:00pm.

They must be using an auto-dialler, it is so regular.

I will be forced to change my number which is a nuisance!

The calls come from 08009172225

Is there any body that I can complain to, this is clearly harassment!

    Oo yes Geoff - did the statute barred letter tell them you would report em? - lots of DCAs in trouble with OFT already for this (not sure if cabot specifically).

    If this is happening then you can complain to your local trading standards department in the council. They can take up your case for you. You can also complain to the OFT. Their address is at the end of the fact sheet. The OFT does not usually take up individual cases but their debt collection licensing enforcement team collects information that can be used to take action against problem creditors, who can even lose their consumer credit licence.

    You can also complain to the Financial Ombudsman again details in the factsheets.

    Yes, I used the standard letter from nationaldebtline.co.uk

    I have just sent a complaint to Trading Standards and I will follow this up with the Financial Ombudsman.

    Cabots are obviously not confident enough to take me to court if they are resorting to dirty tricks!

    Feel free to quote what the OFT said to Mackenzie Hall:
    Mackenzie Hall Limited will not carry out Debt Collection Activity
    where it has been informed, in writing, that the account is statute
    barred.

    Debt Collection Activity is defined as:

    a) sending debt collection letters;
    b) making of debt collection calls;
    c) the use of any other medium for the purpose of collecting an outstanding debt; or
    d) the acceptance of payments offered against a debt.
