Unenforcable Credit Agreements

Hi.. I know a couple of other people have posted about this but am still confused...

I have cc with MBNA, Egg and Capital One and a loan with Natwest all taken out before 2007... Is there anyway I can claim some money back/. Has anyone here tried? I would like to be able to also try and negiotate full and final settlement figures.. Is it worthe doing the Credit agreement thing first??

    Definatley worth doing a CCA request if you are planning a F&F settlement. If they can't produce one they will nearly accept a lower fee.

    Are your debts with the original creditors or with DCAs? If with DCAs your CCA request should go to them.

  • I am doing it myslef... all payments are up to date and I even paid a bit extra off one thsi month... Do i just send the letter template that says I do not acknowldege the debt?

    Then if they reply say I want a final figure... am just confused about what order to try this in...

    First just send the CCA request - here is one version of the template - http://forums.moneysavingexpert.com/showpost.html?p=11636295&postcount=8,

    then wait 14days to hear from them. If you get a response post it back here, if not then send the 12+2day letter out.

    (If it turns out they can't find a CCA, or its not enforceable that would be the time to consider final settlements - there is a template to make a F&F offer when the time comes.)

    Hi.
    To start a thread...

    Click on Forum on the blue bar above....then click on whichever forum you want to do a thread on ie....Credit cards...
    Then click on New thread just under the blue bar and to the left.

    Not very good at explaining things.
