Last year my wife had breast cancer, she went through all the treatment and appears to be on the mend thank god. Whilst going through the treatment we were relying on my credit cards as she was only receiving basic sick pay. We now find ourselves in a position where we pay out more than comes in, I would like to be able to pay my debts, I have a good credit score, no missed payments as yet using the little savings we have. I have been told that there is something called an unenforceable credit agreement whereby you can get the debt written off, is this the case, any help advice greatfully appreciated on this or other solutions to my problems.

Hi and welcome.
You cannot get the debt written off. If there is no Consumer credit agreement or no legally correct consumer credit agreement then the creditors will not be able to enforce the debt in a court (which means they can't get a CCJ against you if you mount a defence) but the debt still exists.
Don't pay any commercial company a fee to get them to check your credit agreements are enforceable - you can do this for yourself for a £1 postal order and the cost of postage (with the help of people on here).
If you are having financial difficulties then I'd suggest you complete a financial statement of affairs using this link- http://www.makesenseofcards.com/soacalc.html
This will set out your situation in detail and if you post on here you get loads of advice on what to do next.
Have you tried moving your card balances to 0% interest free cards (Virgin is good as it has a low minimum repaymen)?
You could also seek advice from one of the free debt advice organisations - http://www.moneysavingexpert.com/loans/debt-help-plan#help - don't ever use a commercial company for advice on DMPs/IVAs etc as they don't act impartially and charge a fortune for things you can get for free.
Sorry meant to add - glad to hear your wife is now on the mend. Do take care of her and yourself - health always has to come before money.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Hiya :hello:
Not sure on the unenforceable credit agreement front, but just wanted to say, well done for joining DFW
I'm sure you'll be fine,
sounds like you've been through a lot but there seems to be a lot of support on these boards.
Good luck on your Debt Free journey

It could be worth contacting your local Citizens Advice Bureau. I know our local one has a special Macmillan sponsored adviser who drives round to cancer patients houses and can offer advice re benefits, debt etc in your own home.
