Letter to remove a default from credit file?

Hi All,

I found out yesterday that Capital One have taken it upon themselves to put a default marker on my credit file for something that was supposedly rectified last month.
I was wondering if you could point me in the direction of a suitable letter to send in order to get them to remove the default and update their records to show that my account isn't over the limit and therefore the default is incorrect?

    I don't think there are any letters for this, but you should write a letter of complaint to them, sent by recorded delivery, stating that you did not receive a notice of default and that the actual default had not occurred as you had discussed the issue with their staff and the situation had been rectified.

    I would wait until i got a response before mentioning the DPA and that they are in breach if the data they hold on you is incorrect. Can't remember what legislation or guidelines they are in breach of if they didn't issue a default notice though.

  • I did receive the notice of default which is what prompted me to ring them last month and demand an explanation...I also made an extra payment on the account to ensure this couldn't happen again...

    If they have issued you with a default notice (erroneously) then you will need to request them to send a note to the main credit reference agencies to explain the default notice was issued erroneously.

    So if I write a letter explaining the situation and the fact that everything was sorted over the telephone (I made a point of noting the person's name and exact time of call) and the fact that the default fee should have been deferred...should this help?

  • Yes just send them all the details to the credit dept and they will respond.

    I did the same with Orange recently and it was sorted and removed within days.
