CSA query - complicated

Hi,

My husband has a child from a previous relationship, he has ALWAYS paid over and above the amount he should.

My concern is that the other parent has recently split with her new husband (with whom she has 2 other children)....now i think things are going to get a little dirty with her and her now ex husband... if she calls in the CSA will they also look at my husbands circs re his son, or will they only look at the circs she has in regards to the new EX husband????

I'm a little concerned as I think we may get stitched up, my hubbie had a CSA review approx 10 years ago when he was unemployed, at that point he was told he didnt have to pay anything but he did pay (via his own mum whilst unemployed for a short time), I think she'll say we havent been paying, shes that type!!!

    If she puts in a new claim then it will be linked; if it is a CS1 case it will be switched to a CS2 case and he will be subject to phasing in of any new amount. If he has had a nil assessment, he has not had to pay so it doesn't matter if she says he hasn't given her anything, as he legally owed her nothing anyway!!! However, what won't count is the overpayments as he will be seen have chosen to overpay. Can I ask, how much does he pay now compared to his net income?

    When i've ran it through the site i think we're paying approx £40/mth too little - but we buy him everything and take him on hols 3 times a year (family live in N. Ireland, we're in England).

    His NET is £1500 per mth and we have a son together. SS stays with us 1 day per week and with NRP mum 2 nights per week.. We're paying £120 per mth to PWC - but we suspect he's not living there but we cant prove it.

    If he stays with you one night per week, you would be a 1/7 reduction.
