Bank of Scotland £900 debt now £5,500

I have an old Bank of Scotland debt of around £900 Ten years ago which was being repaid at £1 per month to the Banks own debt collectors (Blair, Oliver and Scott). But even though they accepted the repayment plan they added interest and charges and the debt now stands at £5,500 !. This debt was passed to Cabot last year who also have accepted £1 per month.
I wrote to Cabot a year ago explaining that £5,500 is not the true amount of the debt, but they told me they would contact the Bank of Scotland, which they say they have being doing but the Bank of Scotland have still not replied to them (After a year), I have now asked Cabot to take me to court as I don't think it is fair to have a debt of £5,500 that only started out at £900 !, but they appear unwilling to do so, and have said that they are quite happy to accept £1 per month.
So what should I do ?, do I force them to take me to court to prove the debt is only £900 and not £5,500 or do I just pay the £1 per month forever more ?. The other Bank of Scotland account which I had and stayed with Blair, oliver and scott have accepted £156 as full and final payment and it was also £5,500 as again they had accepted the repayments but added interest and charges.
Thanks.

What was the debt for? If it wasn't an overdraft, could you do a CCA request?
Have you tried doing a F&F on this debt? Have you tried reclaiming charges? After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

How much of the debt is interest and how much charges? Even though they accepted the repayment plan they are entitled to continue to add interest, unless they specifically wrote to say interest had been frozen.
You may be able to reclaim some of the charges.
I wouldn't ask them to take you to court, the court could find in their favour.
You could do a CCA request as George suggests or it may be useful to do a SAR so you have a detailed breakdown of exactly what was added to the account for charges and interest and when it was added.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Hi,
Thanks for all your replies, yes it was an overdraft in 1999, it was passed to the Banks own Debt collectors who accepted the repayments, when Interest and charges were added I queried it and got a letter explaining that was the way they worked but the charges and interest would be removed when it was settled, they had a name for the process but I can't remember it. But as I said they took £156 on the other £5,500 debt where Cabot will not.
I had just though of forcing them via the court (In Scotland) as they seem unwilling to provide me with the details where the court could make them produce the details (They have told me they are having trouble locating the documents, I can't see them telling that to a Sheriff), they would also have to disprove that I was wrong and the original balance was not £900 and that no letter existed (If I can't find it), the court may also find it odd that they accepted a full and final on one account for the same balance but not the other.
They also keep writing to my wife, even though it was a Joint account and I have told them it was joint which they acknowledge but still only write to her, and of course she does not work.
