Flamming HSBC!

hi all its been a while since my last confession lol!
ok for those that know me i opwe heck of alot of funds i have a dmp with cccs, i have had this since jan im paying my creditors what i can afford however i received a call this afternonn from hsbc concerning my loan apparently the bank refused payment????? i am now over a grand in debt from my old current account as well as teh loan so i say i cancelled all payments from this account, she say's "they cant cancel SO so i argue sayingf "hold on if it was a payment to another company you wouldnt have paid it so you have honered payments from an account that has had all payments cancelled from, funds that were not present! in other words the bank has been taking it loan payment from my current account even when there was no money (current and loan with HSBC) she now tells me i need to make the payment today as the bank has refused to issue this months payment! when i explain my posistion she tells me they will pass it on to the loan manager who will no proceed to claim full and final settlement! so what does that mean? if this goes to court how will i fair ive paid what i can there isnt enough equity in the property to pay off all creditors i cant go bancrupt due to family business and i cant raise the funds any ideas or experiences?

    Just wanted to move this up as im still stressing about them!
    i received another call this morning from their debt manager who was very nice but to the point said they couldnt except our offer and would pass it over to the debt collection agency, he advised me i could end up in court with an attatchment of earnings and a bancrupcy charge against me either way he wont get the money owing!,
    we have every intention of paying back what we owe its just hsbc whop are being really hard to get to agree to it, will the judge force what he has said even though we are paying all we can afford and have been since nov,
    i just dont know what to do anymore

    If you have a DMP with CCCS then surely the creditors whouldn't be contacting you? Get onto CCCs and tell them about HSBC hassling you - I'm sure it could be seen as undue harassment. Dont let them bully you into further debt!

    I agree, if they ring again, let them know that you will ask CCCs to contact them. Good luck!

    Total debt now (April 10) £0! - total paid off £30,221 or 100%
    I'm now debt free after 6 years!!:j

    Cheers, i know your right but it doesnt stop them we are going to get rid of our home phone soon and ive already changed my mobile contract so creditors can not ring me have to say though NEXT are the worse for ringing with demands!
    i hate it because i try and find ways to make money and i jsut need my kidney at the momment even though it has crossed my mind!

    The phone calls will decrease significantly soon. Your still early in your arrangement, and the paperwork etc takes ages to get through these companies. I used to get calls nearly every day, but they are slowing down. Stick to your guns, and keep a calm voice - they will hear the slightest worry in your voice and pounce on it! It must be in the training course!

    hsbc are bad they do worry me but i do try to remain calm right at the start i used to get called daily now it has eased off, with the other companies anyway, we owe 12 creditors in total and have always kept them in the know, i even tried to pay more from our food money and cccs said no it would be unreasonable to pay it and it is needed to live on, any way thanks for your reply i will try and have a good weekend

    ps to show my dedication im going to be paying them for the next 13 yrs at least thats if they stop all interest!
