Debt help

Hi all,

Long time reader first time poster.

I'm a big fan of no-debt and reading some of the threads on this forum has really helped me clear the slate:)

My problem now though is wellas far as i am confirmed quite a wierd one.

My partner and I were staying in a friends parents spare home, paying rent etc although there was no contract and all bills were in my friends parents name.

Now we always took care of bills Gas electricity etc,

Now today my partner has received a phone call from a debt collecter who would give my partner no information other than kept badgering her for her name.

It seems somehow my friends parents are trying to pass off a bill as one we should pay, We have not lived there for 8months yet are now being threatened and told we need to pay for the bill that runs up to August the 12th.

Now i really do just want to ignore this as this is not something I can understand to be right, surely people cannot just change who the debt belongs to? I am not really familiar with this debt collection business. So am I right in thinking someone must have transferred the debt to my name illegally?

I want this to just go away as I am not responsible for the Bill the account was never in my name and if asked I obviously would not accept responsibility for a debt that is absolutely nothing to do with me. So has someone signed my name illegally to a debt?

I hope I haven't rambled there, I am quite on tenter-hooks about this one as it has me worried more than ever?

Sorry if this is not exactly the correct place to put this question but I didnt really know where to turn to? Any help would be much appreciated.

Thanks
Nick

if they can prove that you were there, then yes you would be liable
  • What is the debt for? xx

  • The debt is something for gas and electricity.

As Far as i can see they can't prove i was there, because I wasn't. I imagine rental agreement from the next landlord would be pretty useful here?

I still find it hard to believe that someone with a debt can just phone up and say no it was these people. Surely this is fraudulent?
  • you may find that far from it being the people in the house passing this off, that actually it is just the debt collection agency fishing. Refuse to deal with them over the phone, do not give them any personal details, THEY have to prove the debt is yours.

Many of these agencies will have a punt on the off chance. If tehy come back in writing then send them the 'prove it' letter - there is one on the nationaldebtline.co.uk website I think, if not if you search on: DCA "prove it" you should be able to find a copy posted on here

  • Thanks for the link and advice.

I have always cleared MY debts...emphasis on my. So this one has me riled.

Yes they phoned my partner today who is quite good on the phone, so they didnt get any information out of her, I guess she doesn't take kindly to people phoning her asking her name not telling her what it is in connection with.
