I can't bear to go Bankrupt as i'll never get on the property ladder (something that my partner is very keen to do)

The problem is though, if you are not answering phone calls and opening letters, sooner or later you will have a CCJ or Default registered against your name which takes SIX years to clear from your credit file, so just as bad as bankruptcy... either way you won't get onto the property ladder if you bury your head in the sand. My DH has a default from 2004 and he cannot get credit, its a bloody nightmare, so first off don't ignore your creditors... talk to them!

    Good luck x

PS: does your Dr know of your suicidal thoughts? If not then go back as your meds may need to be reviewed.
  • Hiya All
Im still very new and have loads of questions i need help with !!, What exactly is a default and how do you know if you have recieved one ?? im really unsure where i am with my debt at the moment and not sure where to turn, ive waited for nearly a month 4 my telephone interview with CCCS which was today but recieved a telephone call cancelling it due to sickness i now have to wait for another appointment but feel im going mad !!!
  • Hi jayneben

it might be an idea to put together a statement of affairs (https://www.makesenseofcards.com has a handy calculator) which is basically a summary of your income and expenditure, then if you post a new thread on the board people will come and have a loon and see what help we can give. I know that CCCS are under huge pressures at the mo - you could try calling nationaldebtline or payplan or popping to your CAB if you want that face to face contact, there is also an organisation called Christians Against Poverty that offers advice for no charge that has some face to face branches in some areas (aparently they are big on the debt busting and not so much the bible if you would be concerned on that front)

A default is a mark on your file that basically means that you have defaulted against the agreement, it isn't like the one missed payment mark, it is more serious than that and indicates the agreement has broken down, if you have one you have to be notified in writing of it.

Anyhow, your best bet is to post a new thread and maybe alert people to the fact it has a SOA in it in the title

  • Hiya,

I'm no expert yet, as you'll see from my signature I'm new to this site too and also grew up with continuous credit that just mounts up. I'm now tackling it head on and if you stick around MSE you will be able to as well. It is really empowering to take control, rather than let it control you. You need to learn the details for yourself first, even if it's scary, this will be your first step.

I've suffered with the condition too over 10 years ago but can still remember how I felt very clearly.

    You CAN do this :-)
Me, DH and DD (17 months) clearing our debt for a better future. Then (LBM) = £21,636.43 (Oct 2009) Now = £12128.07 (44%)
    GOALS/CHALLENGES
Try to get credit card to £2k by April 2012 (was £3014.94)
PADing to clear CC 1/1/12 TOTAL: £32.00
Ditch 100 in January challenge: lost count but way over 100!!!/100
  • Chase, you are not an 'extremely stupid man'. You are a regular guy who has so far had ups and downs. We all have. The difference between the people who actively use this site and face up to their personal situations and everyone else is that mostly we're ready to start dealing with things and stop being ostriches. That's what's bought you here so WELL DONE YOU.

It's true what's been said above - things WILL get better from here on in. You are in control of course but the DFW board is full of helpful, sympathetic, honest, supportive people who, to varying degrees, have been there and largely are still there. I guarantee if you hang around here for a few days already your burden will feel lighter.

Seriously, speak to your GP. I know you're on meds and I know you probably feel weary at the prospect of yet another GP appointment but it's worthwhile checking in with him/her. There may be another route to you feeling stronger so it's worth calling for an appointment.

Pop your SOA up so the lovely folks on DFW can chuck a few thoughts your way.

    Chin up, honey xx

  • I am genuinely shocked by the amount of kind replys you guys have left this post. I'm grateful for any and all positive comments you've left so far.

To address afew of the issues raised (and afew more questions if i can, sorry guys) The depression thing, i've resigned myself to the fact that it's never going away, been on med's now for the best part of 6 years, GP's on the NHS have bounced me from pillar to post. I'm sure some of you who've dealt with similiar issue will agree, it can't help but feel like a downward spiral sometimes :-( I told my GP once that I was going to kill myself and the only answer was to up the dose, says it all really. Anyway.....

With my level of debt, should I look into an IVA? i'm sure i'll have CCJ's by now, like I said, with not answering calls or opening letters it's hard to tell. I looked into some companies (Karado imparticular) about voiding loans, they asked for a £495 up front fee to handle it and promised to give me the money back should they be un-successful. Maybe i'm a sceptic but it seems a little too good to be true.

The way I look at it, (and please understand this isn't me trying to evade responsibilities) I will be paying debt for the next 10 years if I don't void or write off some of it. That prospect for me right now is worse than killing myself. I know it's bad to say but honestly I can't do it. It's my stupid fault for making the bad decisions in the first place I know but thats the honest truth.

If I contacted a debt management professional would they just arrange a payment plan to pay the full debt or is it totally impossible to void any portion of it without the IVA/Bankrupt route?

Sorry if my questions seem a bit all over the place, just lost with it all :-(

    Hi Chase,

Well done on taking the first step and posting here for help. I'm not really one to offer brilliant advice (still seriously learning) but others will have really good advice for you.
A couple of people have suggested that you put up a statement of affairs with all your income and outgoings - I do think this would be a good idea. Yes, it will be scary, but it will be a good starting point and you will get a lot of help and suggestions from this.
You may be paying too much in gas/elec/expenses and unless others see this you might not realise it. And then you get recommendations in how to sort this.

    Best of luck

  • hi chase. as you dont own a house an IVA is not for you. A DMP may very well be the option for you to take. as previously advised speak to CCCS or payplan.

They may well advise you that going bankrupt is the best option, however, if you dont want to go bankrupt then just advise them you dont. However, it may be worthwhile considering it. Your credit rating will be shot to pieces right now and the chances of you getting a mtg in the next few years anyway would be slim.

I also hope that once you face up to the debt and speak to cccs / payplan you will start to feel better.

I am quite similar and one day i feel i can do anything, the next day someone can look at me a wee bit funny and it will take me days to feel normal again.

I felt so much better once i spoke to CCCS, they gave me the confidence to face up to my debts
  • Chase - I've pretty much always learned that if you have to pay upfront for it, it's not the best solution. In terms of a company that can 'void' debts, I'd tread very carefully. Maybe make an appt with CAB first and get their take on things? I've read too many threads on here about people who have been scammed by 'too good to be true' companies claiming to be able to get them out of a hole for a fee.

Also, I know you've been doing the meds thing for a long time but have you considered counselling? I know a lot of people would rather pull their own fingernails out but believe me, from personal experience I know what a difference it can make. Your GP can only prescribe medication which will only serve to numb the feelings, whereas a good counsellor can help you discuss what's going on and find ways to gain strength and deal with the situation. Your GP should be able to recommend a counselling service or just Google services in your area. Worth considering love? Suicide is NEVER the answer either - that's a fact. x
