mortgagae broker fees

£295 was the fee the girl at Haybrooks told me i would be paying for them to arrange my mortgage . I have never payed an arangment fee before but she said it would go through quickly and it would only be payed on the completion of the mortgage . So i suppose £295 if it gets me my mortgage. After 2 failed agreed in principle attemts 5 week later 2 lost cheques and a slow or none return of phone calls i sat down with the girl and i told her i thought i wasnt getting the service i required . She told me she was sorry but this was due to the fact that 2 of her colleagues had been dismissed and she was covering for them . I told her i thought my custom was been put at the bottom of the pile because i was buying the property from a different estate agent and only using haybrooks for my mortgage thus getting less comision . Eventually when i thought the deal wouldnt go through and i whent in and sat there for an hour waiting to see her she said she could get me approved with the halifax and it would go through fast but the interest rate would be at a higher rate of 4.75 the others was ie 3.95 and 4.50 So i thought great hallelugha the girls come up trumps ,wait dont get too excited my offer come through at a rate of 5.25 i asked her why this was when clearly on line with the halifax they offer a 4.75 rate and a half price council tax incentive she said she didnt know why but she would get back in touch with me this was on the saturday i then tried to get in touch on the monday left her a message to call me back and i am still waiting ? I eventually whent with another broker they got me the right deal with the halifax i didnt have to pay another valuation because it had all ready been done by them a week prior i got my new offer a week later with the correct rate of 4.75 and i was sorted . Wrong i have just checked my bank statement and Haybrooks the cheeky sods have gone and charged me the £295 for a mortgage i didnt take out with them . I was told this would be only payable on completion when the monies was trasfered . CAN THEY DO THIS ??????

Write a letter of complaint to them and ask for your money back. If you have something written from them saying that the fee is only aid on completion, then that's going to help. If you don't get any job, exhaust their complaints procedure and take your complaint to the FSA.
