Northampton Bulk Centre

Can anyone please tell me why the Northampton Bulk Centre always seems to set repayments at astonishingly high amounts when people have filled in an expenditure sheet clearly stating the amount they can afford to repay. I have read numerous accounts on here where people have been ordered to pay amounts so high that they almost match their monthly income before any other deductions. This has also happened to me.

One problem is with this, I think, that the original creditors who have rejected your initial offer know that the court will set a much higher payment so it would therefore encourage creditors to refuse any offer you make.:confused:

Surely this just adds to the amount of claims going through the courts as if people ask for a redetermination, the whole thing has to be heard again in your local court.

Is there nothing anyone can do about Northampton to make them look at things more closely and take into account the expenditure sheets, as it seems to me they don't even look at them otherwise how do they arrive at the figures they set?

    I may be wrong, but I thought that most courts would take into consideration a persons income and expenditure sheet and therefore often set the repayments at a much lower level than the DCA's are after.

    You can, after all, only pay them what you can afford. They can demand all they like, but if you haven't got it, you haven't got it.

    Others have more knowledge/experience of this area though.

  • Not sure why this happens. However, from what I have read you need to apply to move the case from Northampton to your local county court. They will then look at your income / outgoing list.

    If you do not get this assigned to your local couty court prior to the judgement then when you apply to have the case re assesed you need to move it to your local couty court. I think you have to do this before the first payment is due tho.

    Hi there - I don't work for Northampton bulk centre but we have the same proedure in the local county courts when dealing with determinations. The problem we have is that the expenses that the court allows are very limited. You are allowed essential expenses but the budget sheets that are prepared often include expenses for pets/holidays/tobacco/entertainment/sky etc which is automatically disallowed which in turn can then make the disposable income seem high.

    Saying that though I do use a bit of common sense when doing them and always read the covering letters (if sent) to see the circumstances and as such we don't get many objections (from either party).
