Hi there
Well glad i found this site as so far i have hit a blank wall, my issue with csa is this, i am divorced with 3 kids but i previously had 2 daighters to another partner and have been paying the csa since 1989 for them but as i am now divorced i have a mutual agreement with my ex wife to pay her 300 pounds for them now when i informed csa of this they say the do not recognise it and therefore arent taking it into account when assessing me for payment on the other two hope this isnt to confusing and that someone can advise me on what to do i am getting to end of my tether and money as i am working for nothing just now

The person with no case needs to apply so that your ability to pay maintenance can be assessed for all of your children. There is no need for CSA to collect the other persons maintenance. If she is happy then you can carry on as before.

Unfortunately, unless you have a court order the CSA does not recognise any other maintenance that you're paying.
  • so why is the government encouraging us to form mutuall agreements rather than going through csa then, i dont see why i should have to go thorugh them again personally id rather avoid them is there no other way then?

Thats the question. But if one is going through the CSA then it is better for you to get it all done that way, then they cant say that you have not paid as they have taken it!

That's right - either both or none to go via the CSA as if one is and one isn't they can't take any account of the one that isn't and count the money as though you still had it.

The Government are looking at recent breakups being the only relationship breakup involving a child (ren).

Unless you can sway your first ex to come away from the csa, it is in your case better that both use the csa (I do find it rather sad that you make an offer to your 2nd pwc without considering the effects on your first children or yourself).
