Natwest have....

paid the token payment cheque I sent them for our loan into to our current account which is over our agreed overdraft.

Don't know what to do, we are currently in talks with cccs about an IVA, and as told we have sent pro rata tolen payment of our surplus money to each of our debtors except the bank accounts because when we got paid the accounts were in use and had cash in them. I've been checking the account I sent the cheques from daily to see if they cashed them, they all did except natwest loan, but yesterday a payment for the same amount as the cheque was paid into our current account, not the loan account, which the letter sent with cheque stated it was for. As we are over our agreed overdraft this now means we have no way to get the money back and paid to the loan account, do you think we should just send a cheque for £1 as token payment to loan account. They have yet to contact us over the none payment of direct debit this month either. ARRRRGGGHHH!

I know we shouldn't avoid talking to our debtors but with the exception of 1 or 2 we have just been ignoring the phone and just making contact by post. I dont want to talk to them.....do you think I should?

    How far over your limit are you? And have you paid anything to them yet, or are you waiting until the dmp is set up?

    I think i would say try and send the token payment to the loan again, altho maybe try and find another address?

    When will your IVA start?

    I think tbh I'd also call them but then i'm ok with that and have spoken to my creditors all along! you shouldn't have to really, but i have found it does sometimes help and they sometimes seem to be a bit more reasonable once you've spoken to them! not always the case obviously!
