Aktiv Kapital - 10 year old debt

I am new to this forum and would like a bit of advice.

Last year I consolidated all of my outstanding debts in an IVA.

Last week I got a letter from Aktiv Kapital asking for me to phone them to confirm my address. Having never heard of this company I phoned them to find out what they wanted, as I had been fending off previous creditors who had taken about 6 months to actually acknowledge the IVA.

I intitally spoke to a bloke on the phone who started asking all sort of personal questions, to which I said "wait a minute you have sent me a vague letter with no details of who you are or what you want, tell me more or i'm telling you nothing".

They then said if I didn't give them my date of birth then they wouldn't discuss it as they had to confirm they had the right person.

Having given out only minimal details they eventaully told me that I had defaulted on an account in 2000 and that payments had stopped in 1999.

They stated the original default amount wes £285.00 but they were now looking at a debt of almost £1,300.

I told them they must be mistaken, they did however before telling me this ask if I had lived at a certain address, which I said I had (because as a fact I had lived there). I told then that all of my debt at that address had been paid off before I moved and that there records were incorrect.

I am sure that as this debt is 9 years old (almost 10 years old) it is statute barred.

I also asked them exactly who the original debt was owed to and they didn't know of hand (they could only name the other DCA that they had bought the debt from) but said if I supplied a mobile number they would phone me and let me know who the original "vendor" was.

I gave them my mobile number and they said they would be in touch within 5 days.

This was after they initially promised to phone me back the same day with the details.

What worries me is that after admitting that I lived at the address at the time of the debt and confirming my address to them now, that they may try and take some sort of legal action now that they have found out where I now live, even though I am convinced that I settled all my debts from that address.

In the last 10 years I've got married, had two kids, changed jobs twice and been diagnosed with cancer, I don't need 10 year old debts which I am convinced were paid comming back to harrass me.

Should I send the "statute barred" letter which I have seen on this forum now or wait for them to get back to me as I have no details of the account/debt there letter refers to, all I have is the reference number on there letter.

Any advice on this would be greatly appreciated (I have checked experian and equifax and the debt itself is not shown, however on equifax there are entries for this company and another company trying to trace me).

P.s. sorry it's such a long winded story, it's just finally sorting out my debt with the IVA (seperate from this apparent old debt) I thought I was in the clear.

  • When you make a payment towards a debt it is acknowledged as an acceptance. As you have not made a payment in 10 years + send a statute barred letter politley telling them to ..........

    l had a similar 'fishing' type letter in two consecutive months a few months ago - in a name l haven't used for 17 years!!!! Just ignored it as l knew any debt would be statute barred - and have heard nothing since :rolleyes:

  • It is my understanding that they onlt have 6 years to recover any outstanding debts so tough luck to them.

    I would however ensure that this doesn't come back to haunt you on your credit file, that could be disasterous.
