BR forms and OR visiting home??

Hi,

Does anyone like OR come to the house just like a bailiff would do when going BR?

I know that a form has to be filled in....anyone know what the form is called?
but does anyone actually come to the house?

It would be helpful to see one of these forms before applying for BR... anyone know where I can get one from?

    From what I remember, you just phone up your local County Court and ask for a Bankruptcy pack which contains all the forms you need.
    If the bankruptcy order is made, then you usually talk to the OR by telephone, I think if it is a particularly complicated case, you may have to go in for an appointment.
    As far as I know, nobody visits you at home but I suppose this could depend on your individual case?

    You can call your county court for a form, or go in and pick one up, or apply for one online.

    You will declare any valuable assets on the form, and after you declare you will have an initial "contact-making" phone conversation with the OR who will ask if there are any other assets to add. They will then schedule a time to have either another phone interview with them or an interview in person (usually if it's a straightforward domestic rather than a business it's on the phone). I personally have never heard of an OR sending anyone to visit someone's home, the onus is on you to declare assets.

    They're usually interested in hearing about items worth more than £250 which are not essential to your work or life (so you should be fine keeping a car which is essential for work, and they're not going to come and rifle through your kids toys or anything like that).

    Have you spoken to CCCS or CAB or similar? You'll need to get full and proper advice. Good luck.

    http://www.insolvency.gov.uk/forms/englandwalesforms.htm
    youd need Form 6.27 debtors bankruptcy petition
    Form 6.28 Statement of Afafirs (Debtors petition)
    and the Guidance notes
    The OR would only visit at home in exceptional circumstances: eg disabled requires home visit, creditors report undisclosed assets.
    The Or's agents might come to the house to collect assets but the OR would have informed you of this in advance.
