Question about restarting a claim?

I am the wife of the NRP. My stepson is 17, will be 18 in October. We have always paid the CSA, no defaults or anything, paid since 1999.

When my stepson finished his GCSEs in Summer 2008, the plan was to stay on for A levels. However his GCSE results were not brilliant, and he started the A levels, but only lasted till November 2008, when he left 6th form. The CSA said we had to continue paying until Feb 09 or until he got a job, whichever came first.

No job, so our last payment was in March 09, and the case was closed. Stepson finally found a job in June 09, working in a garage. All was going well, & he was due to start a day release college course this week, so one day a week at college & four days working.

However it now appears that he has walked out of the garage job, & is going to go back to college full time. As yet we dont know what he is doing, DH has not managed to speak to him.

So, questions are these!

1. Can the PWC now make a new claim? (she works full time & is remarried with no other children.)
2. Would a new claim be on the new CSA rules? We were on the old formula.
3. How long would we now have to pay for?
3. Has anyone else been in this situation? Any advice gratefully received.

    Yes she can make a new claim, provided that she is eligible to claim child benefit -so provided that he is under 19 years old, is in full-time non-advanced education then she can claim. Yes, claim would be under the new rules. claim would run from now until either his 19th birthday or until he left full-time education and got a job (whichever is sooner).
