Rbs loan & fos

Been chasing RBS since Nov 08 for a copy of my CA, sent a complaint off to FOS in Feb 09, received a call from FOS on Fri stating that RBS has came back and cannot loacte the CA and that there is nothing more the FOS can do, surely the RBS must be answerable to somebody for this.
Can't belive I've waited all this time to be told they can't help.
Any suggestions greatly appreciated???????????

If RBS cant locate the credit agreement, then no the FOS cant do anything(FOS also wont act in unenforcable agreements either), but If the loan was taken out before april 2007 RBS cannot enforce the debt whilst in default of the cca. ie they cant enforce without a court order unless they find the credit agreement, so now is the time to negotiate affordable repayments/write off of the remaining balance etc, and get in writing from RBS they they wont enforce the loan whilst theres no agreement.

It started in Nov 08, when I promised myself my New Year resoloution would be to get my finances in order, so I started requesting my CCA and checking out intersets rates etc, most complied with the 12 day deadline, but RBS continued to ignore me which made me dig my heels in and do some investigating but in the end had the FOS involved.
I am up to date with my payments, loan taken out Aug 04, I have also found out that there has been 4K added to the loan for PPI, I have recently missed one payment and I am getting hounded by calls and letters, and today I have noticed they have took nearly £600 from my account to cover the missed payments I am so angry as I cannot possibly afford that amount of money from my account in the one go0 -
How much is still outstanding on the loan?0

Move you bank account to a different bank. Stop them offsetting willy nilly.
The PPI you can reclaim as you probably know, but without a CCA then the rest of the loan cant be enforced - however they will stick it on your credit file, so if you PPI plus interest paid plus stat interest you charge them, comes to more than the loan still outstanding it would be better to reclaim that.LegalBeagles0 -
