I purchased a piece of Computer hardware from Simply Computers on 21/11/2004. The item (digital TV card) was intended as a Christmas present and was duly opened and installed on Boxing day. To cut a long story short it does not work and there are a number of faults with it. I have contacted Simply to return it due to it not being fit for the purpose intended but they refuse to deal with me as the item was purchased in November and now state the Sale of Goods Act does not cover the item.
They are not contesting the faults, just the timescale of my reporting the fault, stating I should have "tested" it upon receipt.
Any advice please?

Thanks Troo - The initial complaint was via telephone with a very obstinate female customer services rep. The follow up will now be via snail mail recorded delivery.0

Letter of complaint requesting full refund, with a list of faults is now on its way recorded delivery. Thanks - If this fails I'll be contacting CC provider.0

Result:D After the Royal Mail losing my Recorded Delivery mail I faxed my complaint to Simply and got no response at all. I forwarded all the details to Goldfish CC and within 5 days they have refunded the full £69-99 to my account.
I am now awaiting Simply contacting me to return the goods:D0 -
