mortgage issue with ex-boyfriend

Hi guys,
I was wondering if you had any advice. I split with my ex April 2008 and agreed that he could have the flat we have bought together. We both put £4000 in for deposit. I said that I would be happy for this to happen if he would give me my deposit back and he still is avoiding giving me this back.
He avoids my calls and is living in the house with my money still tied in.
The fixed rate is up in December and I have said all along that I need to have the money back by then, but am concerned that he wont give it me back given his behaviour towards it so far.
Anyone have any advice, I would be really grateful.
