How do they know??

Hi all,

Im just wondering, I havent been asked to prove my income at all by the OR and I would like to know how they know what your income is??

If no proof is asked for.....how do they know???
Do they just take it for granted that you are being honest?? Somehow, I think not!!

When I gave my income details, I tried to give an average of the potential lowest and highest weekly wage because im on a bonus scheme that isnt always guaranteed.

I just dont want to be made out to be a liar thats all.

I went BR last wednesday and I still havent had a phone call from the OR dealing with my case.

  • They know through various routes. Staff at the OR will have access to your bank accounts, your tax records... essentially anything that has a credit transaction attached to it.

When you fill out the bankruptcy forms, and you sign the document, you are declaring a 'statement of truth' to the court where you declared yourself bankrupt. If you lie, you seriously run the risk of having your bankruptcy extended, know as a BRU or a BRO (BRU = Bankruptcy Restriction Undertaking - BRO = Bankruptcy Restriction Order).

The income tax you pay from that date you went bankrupt until the next tax year (so in your case from August 2009 until April 2010) will not go to the tax office: it goes to the OR so they know EXACTLY what you are earning from the tax you have paid. Your payslip will show you paying your tax as normal, but the tax office pay it to the OR.

Some one from the OR should be in contact soon. If not, I would contact them.

Left it is early days yet;). Normally takes the OR 10-14 das to contact you about paperwork, then they usually ask for the last 3 payslips.Dx

as dalip has said some OR's are a little behind with increased workloads...its pretty normal not to hear anything depending on how busy they are a few weeks...they will ask for 3mnths or so payslips...they will ask for any statements from bank/credit etc if you dont have they can & will get so they can see pretty well a snapshop of your spending....at the end of the day OR's have an idea of whats what in your area...they take a lot on trust...they will know if someone has increased figures for something & are taking the micky

  • Well I have been completely honest as far as my earnings go, I wil just be a little wary of accepting any overtime offered to me because I dont want to push the boundaries so to speak!!

As far as bank accounts are concerned, I dont even own one yet (at least until I hear back from Barclays), I have no assets whatsoever either so I think my case is incredibly straightforward compared to others!!

None of the household bills are in my name and are ALL taken from my GF's account. I will be transfering pretty much my whole weekly wage every week to my GF's account (once my cashcard acc is open that is).

Anybody see any problems with that??
  • Anybody have any comments please??:D
