    Hi and welcome Oliver. Some things are different in Scotland so I can't help you on those points. I do know in England that nothing is guaranteed where cars are concerned but you do have a good case to keep yours.

    Blame is a waste of energy and gets you nowhere. You are in the situation you are in and now looking for a solution and way to move forward - that is where you need to concentrate your energy.

    I'm sure someone will come along with answers to your questions.

    Just thought that I'd say Hi and try to help where I can

    Firstly I'm in England and I know that there are major differences between the two countries when it comes to this but under the circumstances you describe it would be a VERY harsh OR who took your car. At that value and as it is the only way for you to get your partner around I would be surprised if it was taken. However cars are funny things in BR and you never know. Sorry that I am as vague as the CAB :(

    I remember being terrified of the whole bankruptcy thing back when it all started, it is such a huge, life changing decision and something I knew nothing about. You've already made two major steps; Firstly you've approached CAB and sought professional help, secondly you've found us; we're not professional and can only offer our opinions and experiences but we have been there ourselves.

    Someone will be along soon who will be able to help you out more I am sure. In the meantime remember that you are not alone and that it can and WILL get better, it just takes a bit of time.
    When you're going through hell, keep going! You will get to the other side eventually.

    That's the beauty of a forum such as this. 99.99% of people on here will not judge, blame or admonish you and many people who have no-one to talk to, or simply cannot talk to anyone face to face, find it easy to start typing anonymously and then the fingers just take over.

    Hi

    I applied for bankruptcy under the LILA rules in June, took less than 2 weeks after handed in forms. I found Citizens Advice great, they filled out forms for me and then all I had to do was send them off with £100.

    I felt a bit embarassed about being unable to pay my debts, but quite frankly if your income is as low as it needs to be to go bankrupt under LILA rules you really won't have excess income to go towards debt repayments! I didn't owe anyone local though, not sure what I'd do in those circumstances, just be honest I guess and hope that they understand. I didn't have a car, I think the final decision on keeping it is down to the Accountant in Bankruptcy but if it's needed you should be ok, or otherwise I think you'd be allowed to trade it in for a cheaper one.
