Not my fault on arrears, can they take it all in one go?

Hi,
Ok I am talking for my best friend here.
NRP has been paying £250 per month for the pat 4 yrs, for yrs 2 and 3 he was living with his partner who had 2 children. In March last yr he left and is living alone he notified the CSA that he was no longer responsible for his ex partner's 2 children.
He has all payment taken by DOE.
Today he has had a phone call saying he owes £1500. back payment as although he notified them, and this is on the screen, they did not take anymore money from him and they now want it all back at 46%!!!
Can he ask for the arrears to be paid back over the same ammount of time they have accumalated?? ie: 17months? It is their fault after all.

It doesn't matter whose fault it was, but there is a guideline which states that arrears should be paid off within a 2 year period - and the 17 months falls within that. Having said that, they will want to get it repaid in as short a period as possible.0

Hi Yes it is a guid but they dont bother with that they will try to tell you it is Law!
You can make a complaint, and at the same time tell them you intend to go to ICE on mal admin.
They should negociate with your friend on this point, so go for a repayment over 2 years, as is said it falls in line with their guide lines!0 -
They have a new dept who's remit is collect arrears as quickly as possible. I just got a letter saying they want £300 a month to pay arrears for the next few months.
These accumulated because CSA were claiming less over the last few months, so it was all there fault. Apparently they tried to contact me (turns out they called my mobile once, which I didnt receive). They know my work address and my home address.
Anyway one of them said they had to collect arrears as quick as possible.
I managed to negotiate mine down though.0 -

He did notice the csa had not increased the deduction and also knew he had not received a revised calculation - he knew he would end up paying more so should have put extra aside for when the csa asked.
The maximum deduction is 40% of pay.0
