inheritance whilst bankrupt

    The estate will be below the interitance tax threashold so no probs there.

    I don't particularly want to administer it myself but having said that I don't want the OR or Trustee doing it either....I would like my OH to do it.....with me on his shoulder so to speak.

    I think that I should go get a free half hour with a solicitor to see what is the best way and correct best way to save any money that can be saved and not put myself in the firing line for appearing to do anything wrong.....even if I don't know I am lol. Then appoint someone to act for me. basically if we could we would do the whole thing ourselves and administer it....having been stung before in the family for loads of money when it wasn't necessary......but this is a bit more complicated than it would first seem. there is a complication that the OH of the deceased died and their estate is not yet sorted either so both have to be done...and there are complications with debt with the estate of the most recently deceased.......then there is my complication. However we want to get a solicitor who would let us do leg work for them such as letter writing to share people etc as I am blowed if i want to lose even more money to £100 a letter here and £50 a phone call there.......being involved with solicitors you may as well put the dosh in front of you and set fire to it......and if they don't take it the OR will......and if they did force a sale of the property I would be fuming.

    For gods sake £50 for a search isn't it enough I just tell them and print out the London Gazette and Insolvency register for them to see....or indeed take my own laptop and log on for them. Money for old rope isn't it.

  • oh maybe I should also add that the other deceased party died some while ago and it was not one of those if they don't survive by 28 day things.....they were also intestate....but all their inheritance would pass automatically to the most recently deceased.

    A bankruptcy search is £2... and yes, much better that you do tell them. You can apppoint your OH to deal as your attorney, but why not just do it yourself with him helping you? I don't understand.
  • Because I just don't want to....I just don't feel able to get involved with it myself, probably sounds stupid but it's how I feel...also I have to work away quite a lot and he doesn't....my work is really short notice. So if booking solicitor appoints etc I might have to cancel at the drop of a hat, so it better he does it as he will always be around and has nore time.
