form ex160 - app for a fee remision

Well, it's the day before my OH goes to court. Just about gathered the court fees for him, but I 've come across the form ex160-aplication for a fee remision. We've worked out that he qualifies under the low wage section, but now I'm puzzled and can't seem to find out weather he is meant to pay the fees first and than claim the refund, or submit the form before he submits his BR petition. Any advice please,as I'm panicking now.

  • Hi there

Can do both. If you have the evidence the court needs for the exemption and it is current then you can apply for fee exemption on the day. If you dont have this evidence but can produce it later then you can pay the fee and claim it back. (This is just for the court fee though not the BR fee)

Thank you Feelingfoolish, suppose he will just have to apply after, as it's too soon for me to start gathering all the proofs (my organisation skills are a bit dodgy lol). And that is just for the court fees, ouch, next month is going to be tight, and I still have to gather my fees somehow.Oh well, every little helps, in the words of that store we cannot afford to shop in lol.
