CSA arrears - can they do this?

  • Sorry, not been on for a few days and have just been catching up on your comments, for which many thanks.

    OK to clarify: the CSA say that the payments are due from Nov 2007 to Oct 2008 (when the rules changed). The PWC contacted the CSA in Nov 07 following a row and the fact that she wanted to get more money from the NRP - up until this point there had been a private agreement in place. Nothing was received by the NRP from the CSA requesting payment, etc. Then the anomosity was sorted out, the NRP carried on paying via a private arrangement and, I think, that the PWC contacted the CSA to say that she had arranged payment via a private arrangement. Nothing further was heard from the CSA. That is until about 2 weeks ago when this demand for £800 was received. During the whole time that my partner was paying privately he has hand written receipts for the maintenance payments - however, I would agree that it might be argued that this is fabricated, forged, or whatever. However, he is a devoted father and has been religiously making these payments - these are not made up. He changed to standing order payments about 6 months ago to ensure that there could be no argument about payments made.

    I think that I've clarified everything here now. I strongly believe that there is a major injustice here - my partner is an honest, law abiding citizen who has always provided financial support for his children. He doesn't want to find himself on the wrong side of the law by not abiding by what a government body requests. Or are they just targeting him because he is an easy target?

    This figure represents £15 per week - is that what was paid or was he supposed to pay more (as per CSA assessment) and this is what a shortfall in the difference was?
  • I don't know if that was the amount for the whole period or not - I think it was for part of the PERIOD Nov 07 to Oct 08. He never received an assessment from the CSA. He was certainly paying more under his private agreement. The problem is since speaking to the CSA last week he's heard nothing (they were supposed to call him back to clarify). He's reluctant to get back in touch with them until he feels more informed about the situation.

    He needs to get information on the effective date of the assessment, the weekly amount he should have paid, where he was sent the notifications of what he should have paid etc
