Letting Agency Fees Problem

Hello

I have a little problem with my old letting agent...

Basically...I forgot to cancel my standing order (of £147 ish) and my account accidentally sent them an extra rental payment, which I didn't notice in time to recall. I have asked for it back and they're willing to do so, but with an admin fee of £25!! Are they allowed to do this?

I have read on a number of websites that some charges are illegal (on this website it talks about illegal bank charges).

On a side...I also had to pay a £100 holding fee when I first rented the flat...is this the same case (ie an illegal fee) and could I get it back if I really tried hard? Just wondered

Many thanks, Paul

Well if you have to write again just say that you will also charge £25 per letter admin fee until you get your money back.
I don't know about the holding fee as you have not given enough information about why you had to pay it in first place and if the Letting agency gave you any terms and conditions about whether you would be entitled to it back or not.

MrPea: the refusal to return the extra money (credit to their a/c) may amount to a criminal offence. I suggest you report them to trading standards etc.

It is my understanding that unless charges such as this were clearly outlined at the outset of your contract then you cannot be charged them. Check this out with your local Housing Aid or Shelter. If it is correct simply write once more giving 7 days to pay and then start court procedings (very simple and can be done online)
