Aktiv Kapital harrassing my mum

Hey mb

Unfortunately I doubt she will ever see her money again - I think I recall reading something along the line of money being paid to an uneforceable account being regarded as a 'gift' or similar. I may be wrong, though...
Anyway, you can ignore the bluster about having to obtain the CCA from the original creditor, so it might take longer than you hoped - AK are fully aware they only have 12+2 working days to provide the CCA or they are stuffed, so if you don't hear from them in that time you can send them the 12+2 day account in dispute letter

Thanks Jes
Shame she's given quite a large sum to such a horrible company as a gift though  I know she's relieved they've called off the hounds for the time being. The 12 + 2 is due to go on the 17th (I think - wrote it on my calendar so I wouldn't forget!).Debt at light bulb moment - £15K
Currently stands at £2.6K
Current debt-free date: far far away

My mum has been hounded by these people too. She has alzhiemers disease so I started to sort stuff out for her.
I had a phone call from them on Saturday. I rang back and the girl said the installment of £10 hadn't been paid. The agreement was £5pcm and is paid by standing order. Last month they rang my mum and got her to give them her bank details over the phone and they took £10 out of her account and got her to agree to £10pcm.
When I pointed out to the girl that my mum was mentally incapable of agreeing anything she told me not to take that attitude with her. After a second time of her saying this further down the line I told her I would see her in court on my mum's behalf.
She then requested a copy of mum's bank statement to prove the money had been paid.
She didn't like it when I told her the original £5 was sitting in their account as an unreconciled item.
I have decided to send a copy of the one line of mum's account without any balnce showing to prove it was paid.
I will also be informing them that no futher verbal communication will be entertained and I will not be spoken to as the debtor as it isn't my debt.
Further I will be informing them that no future communications of any sort should go to mum or I will contact her care manager at Social Services and they can deal with her in future.
My mum is 86 years old and doesn't even know what day of the week it is. She also can't always remember what year she was born.
I hate bullies so they have met an imoveable object, i.e. me!
Good luck sorting out your mu's debt with them.If at first you don't succeed try, try, try again.
