This is with Allied International now and still not come to terms with them, BH wont even talk to me saying I must speak to AI
The best deal they can offer me is £4k to which I refused I said £2k is the most I am going to pay and its been 2 months and they have not got back to me??
Not sure what to do now as my credit file with regards to this is still green. I want it off my file and I am prepared to loose £2k for nothing as I was stupid but not £4k for a car that was in my hands for like 5 minutes. Did I not read somewhere that they are only allowed to charge me a few months interest as a penalty and not 5 years??0 -
Update it has gone from being green on my experian
report to being defaulted

Another update to this. After fighting with Black Horse and getting the default removed with the help of FO. I thought all was well untill today I looked at my credit report and now a company called Hillsden Securities limited have placed a default on my account for the same amount but defaulted 2008 now?? Also instead of calling it HP they list it as a loan. It is getting very silly as it was gone for a few months now its back from another company with a new default date?
What should I do now?
Also just noticed they put the address as 36 but I lived at 36a its an old address I lived at 3 years ago but still does that make any difference?
I just spoke to Hillsden and they dont have any record of any debt for me so now I am at a loss0 -
I guess I am going this alone lol
Oh and now Hillsden do know me and say Black Horse passed them the detail about the HP roughly about the same time Black Horse removed the default0 -

I would like to ask, did you ever receive a reply from the company when you asked them to provide you details of your loan with them under the data protection act? I'm considering sending it to my finance agency.
Did you also have to enclose a fee? I remember reading some place that you have to enclose £10 for their time.

I sent a letter to Black Horse with £1 postal order, its £1 for CCA and £10 for a Subject Access request. They sent me back a letter saying they did not know me as my address has changed so I am at a loss as Black Horse wont sent me the documents I have requested.

Thank you for clearing that up for me, I wasn't too sure how much or what I would need to enclose money for.
My situation is on here under the title of Welcome Finance / MKRR (Help requested plz) - You'll have to search for it as the forum won't allow me to post links being I'm a new member to these boards.
I will definately give the letter template on this thread a try to see what information I get back from our finance company.

Right, neolight90....you need to see a solictor as this has dragged on for over a year since your original post. If Black Horse are saying they dont have a record then you need to continue chasing and chasing....I spent 2years calling different debt collection agencies for a £30 BT amount that defaulted and CCJ'd. No one took responsibility and I naively thought it would go away. If you want some assistance on this, then you need to pay a solicitor. Getting information from people on here is one thing but we wont clear your credit history - only you can!
See a solicitor, explain the situation etc. Them writing a letter to the debt collector/BH will have more substance.:grouphug: - we can only dream :rotfl:0 -

Spoke to Black horse again it seems not only did the sell the debt on when it was in dispute that they have no idea what the default is doing on my file and Hillsden said its Black horse and Black horse said its hillsden.
Black Horse also admited on the phone that they have never sent me a default notice does that mean they can't default me?
I would like to get legal help but I cannot afford it at the moment0
