CD WOW returns policy... £1.50 handling fee???

I ordered a CD from CD-WOW for a Christmas present. I ordered it before their order deadline for Christmas delivery, but it didnt arrive until yesterday.
Now, upon checking the CDWOW website I note they charge a £1.50 handling fee for returned items.
Is there anything I can do about this... seems rather unfair seeing as I ordered before their order deadline!

    They have breached their contract with you so it is not reasonable for them to charge you a fee for returning the goods.

    Is there an e-mail address you can contact to put your position? This happened to me last year with an internet order and the company agreed to take the items back, have them collected from my address and waive the handling fee or, if I still wanted to keep them, credit the postage element of the bill back to my account so delivery was free. In my case, I decided to keep the items (although I was tempted to return them just to make a point) and I did get my delivery charge back.

    Check the distance selling regulations.

    As they have accepted EU jurisdiction for copyright issues I think you can use them. You have a statutory right of return and refund for most goods including your and their postage costs.

    You don't even need a reason. Had a friend argue with a company about this when they tried to charge a 'restocking fee'. You ring them or email them informing them you are excercising your rights under the distance selling regs NOT their returns policy.

    Its the part they mean when they say 'your statuory rights are not affected'. So use them!

  • While we are arguing about UK Contract Law and Distance Selling Regulations here, it is worth pointing out that they are only in breach of contract ergarding a late delivery IF you specifically told them that delivery was required before Christmas and they agreed to do so. I suspect that just ordering by the 'last order' date may not be enough in law.

    That said, CD-Wow's customer service is pretty good - have you emailed them yet to ask them about this? Just a thought before we all reach for our barrister's wigs and gowns! ;)
