No Its not overreacting - its just a naturall fear that happens in life when things go wrong - some sort of paranoid reaction, survival instinct hightens the senses. Any way there is a law of harrasement - I probably should'nt say this here but the www.consumeractiongroup.co.uk have a wide range of letters and templates - worth joining as well - more useful than some organisations that I know of!0

You are very welcome (excuse the cruel pun), I know its difficult for you, I didnt realise you are in Scotland, if its 5 years up there then that does explain their sudden contact before the debt "falls off the edge" as it were. As i mentioned earlier, if you can, sit tight, ask your friend to keep schtum and hope for the best, do not ackowledge them or the debt in any way..it is ultimately up to you, but thats my advice Star, take care.I Am What I Am And What I Am Needs No Excuses:D0 -
Hi I agree with the above and sit tight as your debt is statute barred. You dont need to do anything. However if they keep hassling your friend she just needs to quote the below to them. As they are not entitleed to harrass her in this manner Debt collection harassment should never be tolerated and should always be reported to the Office of Fair Trading. The strongest asset towards beating debt collectors who practice harassment is for consumers to assert their rights. Debt collectors prey on the debtor’s lack of consumer rights awareness. Those in debt should always seek advice through debt help agencies such as the Citizens Advice Bureau or the Consumer Credit Counselling Service. If you need any further information you can grab this off this site on a search or the financial ombudsman. I asked my brother about this over dinner he is a solicitor hence the long post as I copy pasted what he sent me on email. DO NOT CONTACT THEM IN ANY FORM AS THIS WILL REVOKE THE STATUTE. Your friend should tell them that if they phone again, it is both CRIMINAL harassment, and a breach of the Data Protection Act, as well as against OFT guidelines, to be discussing this with anyone other than you. And that she will report the matter to the police and the Information Commissioner's Office if she gets just one more call.
MMG-SAVING is, of course, talking complete boolsheet. If the debt IS statute barred, and there is no CCJ against you, then it doesn't matter what you do; nothing revokes the fact that it is SB'd.
I suggest MMG-SAVING's brother should go back and read up on some simple law... the Limitations Act 1980 might be a good place to start.Cabot can now kiss my DONKEY. Statute barred is enough of a result, but the actions of the CABOT FAN CLUB have cost them far more than the paltry sums they were chasing us for. :beer:0 -

With respect, I think in this case, the debt isnt Statute Barred, where it would seem Star71 still has a year or just under still to run, any acknowledgment of the debt can and will allow the Creditor to begin the whole process of recovery again. That is the issue here, OP was/is worrying about whether to contact Welcome to take the heat off her friend who they are pestering relentlessly.
