Handed in notice, work term time only...

I am leaving work where i work term time only and have been there for one year. I am starting a pgce in September. I took my notice in over the holidays which equated to exactly 4 weeks so i could leave in time for my course and still get paid.

My employer called today to say that it doesn't count giving in my notice over the holidays and i would have been expected to work till 27th september (i go back on the 27th august and leave on the 4th september). She said they will waiver it but i will only get paid for 4 days instead of the 3 weeks i would have still been employed had i stayed there, can they do this?

If i hadn't left and i carried on being employed then i would still have got full pay even over the holidays so i don't understand.

Can anyone shed some light?

    Presumably you get paid some sort of a retainer over the holiday? I think for something like this, there may be a special requirement to give notice before the summer.

    I do get paid over the holidays yes which is why it doesn't make any sense that i wont get paid.

    I am a teaching assistant yes, well it's not my actual job title but it equates to the same thing.

    I work in a school and if a teacher wishes to leave over the summer holidays, they have to let the Headteacher know in May. I'm not sure what the rules are on teaching assistants though. I should imagine it would be a similar situation. If a TA gave 4 weeks notice in the summer hols the school wouldn't have time to recruit a new TA, so when the children came back in September it would cause major staffing problems.

    Check your contract though and good luck!

    That is exactly why it DOES make sense. You are not paid for work, you are paid a retainer, so there is probably something in your T&C's to specify how you must give notice over the summer.

    if you are contracted to work term time, then chances are thats all you're being paid for, term time. you may get paid over the holidays, but not specifically for them. I'm contracted myself for term time work but get paid every month so its easy to budget. but the 6weeks hols for example, I don't get paid for - just happen to be paid every month.

    if that is the case and is stated in your contract then i beleive notice would expect to be served, during term time. i'm sure somone will correct me if im wrong but good luck in sorting it :D
