Question

Hi,

Just a quick question- hope someone can help! We had a property that we rented before we declared BR. We're in the middle of trying to clean up our credit file as we were discharged in February (whoopee) but BOS, who the mortgage is with, are saying that the account cannot be satisfied on it.

They say it can't be done "until the repossession has been completed or the property has been sold". They also write that "arrears will continue to be registered on [our] credit file". Surely this can't be right?!

Thought arrears etc were stopped once BR was declared? And we are discharged too, so how long can they keep doing it for? We need to sort out our file asap because we need to buy a car and this is really causing us issues.

Any advice will be very greatly appreciated! Many thanks in advance x

    I'm afraid they are right.

The mortgage isn't included in your BR until the house is officially repossessed and is still your liability until that time. So BOS are quite within their rights to carry on adding interest and charges, and recording the missed payments until that time.

As an aside, did you inform the council that the house was empty. You will have been given 6 months relief from CT, but will then be liable until the house is repossessed.

  • Thanks for the quick reply. Well I had a feeling that you might say that but was hoping I'd be wrong. Suppose I could chase our trustee to hurry up with it but he seems to work at a snail's pace. Have lots to sort out on our file, so many companies have not put down a default date, let alone satisfied one and I did write myself on both occasions to tell them!

Ah it never ends, does it. But thanks all the same :D
