Need updated P45

Hi All,

I was made redundant on 30th June 2009 since then I have had no income. I got my last Salary Slip and my P45. It was only last week I found that my 3 hour Over Time was not paid. I went back to the company to claim it. They acknowledge my overtime and will pay that as back pay. They will send me my new updated Salary Slip and statement of earnings till June 2009. Now the issue is that they are not going to provide me with the updated P45 what they are saying is “I cannot produce another P45, this is against legislation as I have already sent part 1A to the Revenue”. I don’t know if this is right or not, all I need is my new updated P45 that reflects my total earning till date. How can I get this? Please help.

    They are correct in saying that a new P45 cannot be issued.
    Below is the employers' guide instructions from http://www.hmrc.gov.uk/guidance/cwg2.pdf
    "In such cases, you should provide the employee
    with documentary confirmation of the payment (for
    example by letter, payslip or other printed/printable
    document) giving the following details:
    the date of the payment(s)
    the gross amount of each payment
    the amount of PAYE deducted from
    each payment
    confirmation that the payment is a post
    leaving payment.
    You must not give the employee another form P45.
    You do not need to notify us at the time of making
    the extra payment, although you must ensure that it
    is recorded on form P14 at the end of the tax year."

    Assuming that they taxed you at BR they have acted correctly, and if you are paying tax at 20% it will work out correctly, otherwise they will adjust next year.
