Legal Rights on Toys?

Hi all,
I've had an issue regarding an item I bought from the Crawley 'The Entertainer' store.
I purchased a Nikko remote control jeep monster for £29.99 in December.
The jeep has malfunctioned and no longer works.
I took it back to the store for a replacement or refund.

I've been told that I only have a three month guarantee from the store, and for me to contact the supplier.

I've contacted Nikko who tell me that the guarantee is with the store as Nikko are n longer in the UK.

I am now stuck in the middle, with 'The Entertainer' and Nikko, and still no way forward, or working jeep!

(I note that 'The Entertainer' are still selling Nikko toys).

Help anyone?

    The contract is with the store you purchased the item from, so they have to deal with it.

    Stores will often only give an exchange or refund within 30 - 60 days. After that they use the manufacturers gurantee. But the store should still process the faulty item on your behalf.

    i'm not sure exactly what the law is called BUT an item has to be fit for purpose. since the toy is less than a year old you may have a chance to push that avenue, this is for the store to sort out not the manufacturer.

    if you do a bit of googling you should be able to find out more info on this subject.

    toys i'm really not sure what would be expected for something to last however say you had a computer monitor that broke after just 8 months and you couldn't get the manufacturer to replace or fix it for you then you could take it back to the store as it would be expected to last far longer than that (3 years is about standard for this one in particular) and therefore it was not fit for purpose.

    anyway, do a little googling and hopefully you can get something sorted, best of luck

    Sale of goods act. If faulty within six months, the item will be presumed to be faulty at the time of purchase. Up to the retailer to prove fault due to misuse. Contract is with the seller, any arrangement between the manufacturer and the store is nothing to do with you. Up to the store to make good the problem within a reasonable time.

    Read up on "returning a faulty item" "sale of goods act" and all should become clear.
