Query entry in credit file

I've been having ongoing discussions with Experian (Via Email) regarding an entry in my credit file which I'm not familiar with.
Experian have placed a notice of correction on my file, but this has been in-place now since the beginning of February. I've I chase up Experian, the reply I usually get is that they are still awaiting a reply, nearly 4 months on!!
There appears to be no movement from either the creditor (whom I contacted before Experian on a couple of occassions but never received a reply), or Experian. Surely this can't go on for ever?
I remember a few years back, I had a similar issue with Equifax and they removed the entry from my file because the creditor didn't respond within 28 days. Is this an Equifax policy or the law?

you need a 'notice of dispute' and not a 'notice of correction'.
a notice of dispute must be responded to in 28 days (that doesnot necessarially mean resolved however.0 -
Is it a CCJ?
If it is then contact the court of judgment (it will tell you which court it is on the credit report) and ask for a Certificate of Cancellation. If you have no proof that debt is paid off (for whatever reason) then the court will write to the creditor asking for them to respond to your request for a Cert of Canc within 28 days. If they not respond, the court will issue you with a certificate anyway and the Registry Trust will be sent one too so the CCJ will be wiped from your file.
You have to pay the court a fee of £10 (might have gone up) to do this.

Thanks for the replies. It's a default on my account. It's a notice of correction against the entry in question which reads like so;
"THE ACCURACY OF THIS DATA HAS BEEN DISPUTED BY THE INDIVIDUAL CONCERNED AND WE HAVE NOW CONTACTED THE SUBSCRIBER. CARE SHOULD
THEREFORE BE TAKEN WHEN USING THIS ITEM OF DATA TO ASSESS THE CREDITWORTHINESS OF THE INDIVIDUAL CONCERNED."
There doesn't appear to be any mention of a "notice of dispute" on the Experian website.
I seem to be getting nowhere fast here with Experian. What can I do now?0 -
i would suggest you write back along the following lines
reference etc. etc.
i wish the matter to be treated as a formal Notice of Dispute under the section 159 of the Consumer Credit Act 1974. I believe you have a duty to contest this information and provide a response within 28 days.
note: this doesnot unfortunately mean that the matter will be resolved in that time...but maybe hopefully.0 -
