Evening all !!
I'm not sure if I'm in the right chat area but didn't know where to go???
My Hubby works for an independant electrical retailler as a sales person, he is paid an hourly rate and then gets commission on top depending on what he sells/rents etc.
He has informed his immediate manager and area manager that he thinks the security for the products is not good enough and some of the advertising displays obscure the view of some products near the door therefore making them venerable to theft.
If an item is stolen (an LCD screen TV last week worth £1500) then the whole sales team have an amount deducted from their wages every month until the cost is regained!!!
It says on this months wage slip "-£9.15 pooled fines"
What amazes me is that they are advised if anyone tries to steel from the shop, let them and call the police as they may be armed (which I agree), but as we are short of cash my hubby has chased a few thiefs through the high street to try and regain the item, sometimes it works, sometimes it doesn't.
The boss says as commission is at the companies discression then they can deduct if they want to.
Does anyone know where we stand???

I'm no expert but certainly in my area of work ( public sector) no deductions can be made from pay for anything ( other than tax, Ni etc) without the explicit permission of the employee. I am sure i understood this was ACAS guidance.
Sorry i can't be more help.

Firstly, read the contract he was given by his employer (assuming he was given one). Check what it says about how commission is worked out. The thing to check is that if they have a clause in there that says that they have a right to deduct monies for stolen goods.
If he doesn't have a contract, then check with ACAS as to where he stands with this. Also, has this happened before? If it has, then even without a written contract, it could be classed as an implied/accepted contract.
Terms and conditions of his employment need to be checked and confirmed.
I am perhaps not much help but I am sure someone will come along with some very good suggestions/ideas.
Good luck and keep us posted.0 -
Thanks for tha advice, he has been with the company 6years and had an initial contract when he was an installation engineer but it wasn't updated when he went into the shop, so thats not much help. I shall investigate with ACAS. Thanks againPersonal Loan: £11,488 3.7% Credit card: £5,946 0% Total = £17,4340
