    I will send this recorded delivery tomorrow and hope that will be the end of the correspndence. I do wonder over the Abby Nat's actions as they know these laws as do the d/agency. Luckily following many errors over direct debits we moved mortgage and closed all bar a paying in account, years ago. Coincidently we closed this one account last month.
  • i have a question here. I need to know the exact calculation for early settlement using rules 78. If a customer got a personal loan amount 20,000 for 60 months(5years) with effective interest rate 14.99%. The early settlement fees is 3% of the outstanding balance or 200 whichever higher. If the customer clear it during 38 months, how much the customer need to pay. Please show me. Thx
  • I just received the same letter from a debt collection agency saying they purchased an account from Abbey Nat stating that i owe £2840. On phoning the debt recovery agency they told me that the loan was taken out in 1990, I dont remember any loan and I also have had accounts with Abbey since this time and no contact regarding any debt has been received. I have moved four times since 1990 and Abbey have always had a contacting addresses. I have told the debt recovery agency to put this on hold for 14 days while I contact Abbey.

    What else can I do as I thought after six years a debt would be void if there was no contact about it.

    Read through the previous posts and links.

    Even if the debt should be valid, it is most likely "statute barred" and therefore legally unenforceable against you.

  • I also have a debt of about £500 which allegedly been in force for the last 19 years, which I only found out two days ago.
    The debt is for overpayment of income support from 1990 (which i cannot remember ever having) Do the debt management department of the DWP adhere to the statute barred rule? I have spoken to them and they say the debt lasts for life if not paid.
    The letter states that I have been sent about 6 letters explaining about the debt and the appeals procedure, however I can quite safely say that I have never recieved any previous letters.

    If you dont pay a debt to the dwp they can at anytime in the coming years deduct it from future benefits.
    Some people will say that statute barring doesnt apply to dwp debts,thats debatable,but the above does mean that one day they will get their money.

    Not debatable at all. :confused:

    They are "barred" from taking court action to recover it.

    But the debt still exists, and so can be deducted from future benefits.

  • CAn anyone confirm if this Statute Barred debts. also relates to debts from DWP form 21 years ago.

    Due to a deduction from my state pension of £50 today i have contact to find out why this happed to be told i owe £899 from 1989 - 1990 for a social security over payment - i have no idea what this relates to and have never been contacted regarding this, i have been residing at the same address for last 34 years.

    any advise would be great

    The situation is explained succinctly in the post above yours - they cannot take you to court over it but they can deduct it from money they owe you.
