  • Hi guys quick update on the above thread.

    Contacted Investigation company by email and told them I no longer live with my wife and that I would arrange a time to call and collect statutary demand from them.

    Was busy and didnt get chance for a few days and as hadnt heard from them thought I'd stay quiet.

    Called in to see my kids yesterday and wife gave me a letter which had been put through the letterbox. It contained a statutary demand from the creditor.

    As this was put through my wifes letterbox they have no proof that I have received it, with this in mind would the creditor still be able to proceed with a bankcruptcy petition without any correspondence or signatures confirming I have any knowledge of the statutary demand?

    If I hadnt seen this demand or any petition would they be able to proceeded with it, how would I have known I had been made bankcrupt? and if so would the O/R proceed without my knowledge or help re: other creditor, bank details etc?

    I just want to know how I stand before I acknowledge this demand and make an offer to the creditor.

    Yes they can proceed with bankruptcy without your knowledge.
    You would receive notice from the court advising you that you have been made BR in your absence. The OR would then contact you with forms to fill in. If you do not acknowledge the OR you will reamin bankrupt indefinitely until you do contact them.

    So best option is to negotiate a repayment schedule with the creditor.
