Can anyone help
Got divorced about 10 years ago and still have outstanding debt on a loan. Have tried head in sand method and although this worked quite well i have now resurfaced but so have debt collection agencies. Can a loan become unenforceable due to the length of time elapsed or do i need to make like an ostrich again?

  • I think avoiding it will only make it worse - can you not make any payments towards it?

    You should contact one of the debt advice departments - e.g. http://www.nationaldebtline.co.uk/ . Tel: 0808 808 4000 (free and independent advice). They will be able to advise you of specifics.

    Also, if you post a statement of affairs here, then people will be able to give you some help (there's a lot of very good advice from a lot of theforum members here - many speaking from experience), they will be able to suggest changes tht you could make to make to help you save money.
  • If they have not been in touch with you and you have not acknowledged the debt for the last six years then it is statute barred.
    Perhaps you could clarify one thing though - was it a joint debt? Has your ex being paying for any length of time?

    This was a joint debt due to selling house with negative equity. The ex met a rich boyfriend who paid off her half and I found I couldn't pay due to other commitments like CSA. Have move addresses quite a bit since then and had several letters from different recovery people and have always not replied. Had a visit to the door from one last week but was out so they left a letter asking me to get in touch.
  • On a joint debt there is no such thing as paying her half - you are both jointly and severally liable for the whole amount.
    You need to know exactly when the last payment was made to this debt before deciding your next course of action.
