Resignation, sickness n Hol's working for Tesco

Hi please can anyone give me some advice? I was in full time employment as a line manager for Tesco, I then went on maternity leave n came back to work as a part time Team leader. I took on my new role with the company with set hours of 9 - 6 fri and sats due to being a single mum and child care, but they keep making me work late nights, I don't mind the odd ones but I find it so hard to keep doing them. I have spoken to my manager and she still hasn't sorted it out. I have been off sick for one week and the 2nd week Iwas on holiday, i'm due back to work tomorrow and surprise surprise i'm late night. I am going to hand my notice in as I can't do these hours, I believe I can give 1 weeks notice, so if I hand it in does it mean that I finish on Thurs, if i've handed it in Fri? Can they also get funny as I was off sick for one week? I also never signed my contract is that gonna be a problem?? I'm so nervous as i've never done this before and really need advise....... Also what if I walk out?? as I think they're gonna be funny with me, I rang up to check my hours and one of the staff members started coming out with smart remarks which has made me dread it even more!!

    OP, what does it say in the contract for giving notice, do you have a handbook as it might be in there as well, re the notice it all depends how long you have been there, you were sik but theres nothing you can do about that,
  • Rather than resign speak to your line manager about the late nights.

    Say you have been happy to help out and are willing to do so in the future but it cannot become regular as this was not your agreed hours. Tell her you are already unhappy at having to take time off sick and you want to resume the hours you agreed. Put it in writing and then you can refer to it again if it is not resolved.

    I would put in writing a formal request for family friendly flexible working in whatever format their policy requires. Then they must assess and accept/ reject with reasons.

    I wouldn't walk away just yet.

    You have continuity of employment from before your maternity leave. You don't have to sign a contract/written statement of particulars of employment but you will be bound by the terms if you received written particulars in the past which required you to give more than a week.

    If it is a week then if you handed in your notice on a Thursday your last day would be the following Thursday - that it is because it is seven clear days that are required, the day of handing in your notice doesn't count (though some employers may not follow this, it could be enforced).

    However, as others have said, it would be better to be assertive about what you can do in terms of hours rather than resign if otherwise the work is suitable.

    My brother worked for Tesco until recently, I hope your managers treat you better than his did!

    Are your new hours in your contract, or just verbal? If contractual I'd state you can only work those hours, if verbal its a bit tougher.

    Verbal is contractual - you mean written? With verbal, you need to be tough minded, but they don't have anything to say that what you claim is wrong. It rubs both ways.

  • At my firm, working evenings or nights is seen as family friendly. All the parents want to do it as getting a child babysat when they are asleep is a lot easier and cheaper than finding someone when they are awake, and that way you get to spend the day with them.

    Don't just walk out without a job to go to though, you should be able to get this sorted out.
