Its now or never

Hi all, i have been reading all the info and stories you have placed on this board and this has helped me make an informed dicession and gave me plently of info.

I intend to go BR as soon as possible, i have the fee ready and as on JSA excluded from costs which helps, been out of work since feb and really down about it, divorced 3 years but i do get on with ex very well and see or speak to my son daily (he is 5). Tried to get as much cash as i can away from any accounts so i can give money to ex for son, and afford to eat etc.

My question is simple, i have debts of £22k no mean of payback, no job, no house, no assets so BR is the way to go, but do i need to seek advice from 3rd party etc as i am not with out a mind and you lot have imparted so much info here.

    Welcome Morty....glad to see your plans are progressing well....one of the questions the judge will ask on the day of court is "have you taken professional advice" if you answer "no" then you run the risk of the judge declining your bankruptcy...just a quick call to cccs/national debtline to cover yourself

    The judge is very likely to ask you if you have taken professional advice. MSE, despite its cumulative knowledge is not regarded as professional, so a call to Payplan, CCCS or CAB is in order.

    The Judge needs to know that you are well aware of the pitfalls to BR as well as its benefits (no credit, no being an MP etc) and the long term problems it entails and could possibly refuse BR if he does not think you fully understand BR and have not taken advice.

    Bear in mind that you swear to tell the truth, the whole truth stuff (well, similar anyway!!) when you pay your court fees, telling the judge that you have taken advice when you haven't is potentially contempt of court. Of course, they also do not want proof you have spoken to CCCS etc. So if you want to tell the judge a fib, then so be it on your own head, of which I am not suggesting you Blag in any way shape or form, of course......


    I did not speak to any organisation about my BR, but I had spoken to Payplan 2 years before about DMP and debt in general when BR was recommended instead - so I didn't lie at all when he asked me.

    thanks skylight, in fact i have spoken to a company whos name slips me, but they wanted £470 to "hold my hand" through bankruptcy so guess i have covered that part lol
